Fiktionsbescheinigung: what it is and when you need one

Short answer: a Fiktionsbescheinigung is a paper from the immigration office confirming that your stay stays legal while it decides on your residence permit. The key is to apply before your visa or permit expires: then your current permission is treated as continuing until the decision (§ 81 (4) Residence Act), and the Fiktionsbescheinigung is the proof of that.

When you get one

  • You applied for your residence permit (or its extension) in time, and the office can't decide before your visa or permit ends.
  • Offices issue it at your appointment or send it after the application; in busy cities ask for it in writing if your visa end date is close. Our German email template includes that request.
  • The office decides how long it is valid. Watch its end date too, and contact the office before it runs out.

If you apply too late

An application after your visa has expired does not automatically keep your stay legal. The office may order that your previous permission continues to avoid hardship, but you have no right to it. That's why the arrival planner marks the visa end date as a legal deadline and suggests asking for an appointment about eight weeks earlier.

What you can do with it

  • Stay and study: yes, while it is valid.
  • Work: under a continuation of your previous permit, its conditions continue, so student work rules (140 full or 280 half days a year) still apply. Show the paper to your employer.
  • Travel abroad: be careful. Leaving and re-entering with only a Fiktionsbescheinigung can cause problems at borders. Ask your immigration office before booking a trip.
  • Bank, landlord, university: it is the official proof of your status while you wait; keep copies.

What to do

  1. Note your visa end date. Put it in your calendar with the planner.
  2. Apply for the residence permit well before it, the way your city requires (online form, email or appointment): see your city guide.
  3. Keep proof of the date you applied (confirmation email, upload receipt).
  4. If no decision before the end date: ask for a Fiktionsbescheinigung and carry it with your passport.

Common questions

Can I work with a Fiktionsbescheinigung?

If it continues your previous permit, that permit's conditions continue, including the student work rules. Show it to your employer.

Can I travel with a Fiktionsbescheinigung?

Re-entering with only a Fiktionsbescheinigung can cause problems at borders. Ask your immigration office before booking.
